Welcome to Coalbank Holler Adventures (“Company,” “we,” “us,” or “our”). These Terms & Conditions govern your use of our website, our booking platform, and your participation in a guided side-by-side (SXS/UTV) tour with us in the Red River Gorge area of Kentucky. By accessing our site, booking a tour, or participating in a tour, you agree to these Terms.
Before participating in any tour, every rider — or, for a rider under 18, their parent or legal guardian — must sign a separate Liability Waiver and Release, provided as part of the booking process. That waiver contains additional terms specific to participation in a guided off-road vehicle tour and should be read carefully before booking.
A note for parents and guardians: Kentucky law may limit the protection that a parent or guardian’s signature on a waiver provides against a claim later brought by the minor. We encourage you to understand these limitations before bringing a minor on a tour.
Guided side-by-side tours involve inherent risks, including but not limited to vehicle rollover, collision, uneven or unpredictable terrain, mechanical failure, and the actions of other riders or drivers. By booking or participating in a tour, you acknowledge these risks and voluntarily assume them.
To the fullest extent permitted under Kentucky law, you release Coalbank Holler Adventures, its owners, guides, and employees from liability for injury, loss, or damage arising from ordinary negligence in connection with your participation. Nothing in these Terms, or in the separate Liability Waiver referenced above, releases Coalbank Holler Adventures from liability for gross negligence, recklessness, or intentional misconduct.
Tours are booked and paid for online through our booking platform. Full payment is required at the time of booking unless otherwise stated. See our Refunds & Cancellations Policy for information about what happens if your plans change.
We operate rain or shine. Coalbank Holler Adventures may cancel or reschedule any tour for safety or operational reasons, including severe weather, unsafe trail conditions, equipment issues, or guide unavailability, at our sole discretion. See our Refunds & Cancellations Policy for information about what happens in these circumstances.
All riders must follow their guide’s instructions at all times. The use of alcohol or drugs before or during a tour is prohibited. Riders must respect the trails and surrounding property. Coalbank Holler Adventures may remove any rider from a tour, without refund, for unsafe, disruptive, or inappropriate behavior.
Tours operate on trail systems in the Red River Gorge area of Kentucky. Your exact meetup location will be sent by text after booking and is not a publicly listed address.
We may take photographs or record video during tours for use in our marketing and promotional materials. If you’d prefer not to be included, please let your guide know before your tour begins.
By providing your phone number, you consent to receive text messages from us related to your booking (including your meetup location) and, if you separately opt in, marketing messages.
You agree to use our website only for lawful purposes and not to interfere with its operation or security.
These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles. Any dispute arising from these Terms or your participation in a tour will be resolved in the applicable state or federal courts located in Kentucky. Nothing in this section requires arbitration.
We may update these Terms from time to time to reflect changes in the law, our services, or our business practices. Changes are effective immediately upon posting. Your continued use of our website or services after an update constitutes acceptance of the revised Terms.
